Privacy policy

This page explains what this website collects, what it deliberately does not collect, and how to have your information removed. If you would rather not put anything in writing at all, call us instead.

We know who reads this site. Some of you have reason to be careful about what you write down and where you write it. So this policy is written plainly, and the short version is this: we collect the minimum we need to call you back, we never ask for your A-number on this website, and you can have your information deleted by sending one email.

What the intake form collects

The case review form on this site asks for seven things:

Your name, or whatever name you want us to use
A way to reach you: a phone number, an email address, or both
The language you want us to call you in
Which stage you think your case is at
Which immigration court has your case, if you know
Your next date, if you have one, so we can tell you what clock is running
A free-text summary of your situation, in your own words

That is all. There is no field for a date of birth, an address, a passport number, an immigration status history, a criminal history, or a family member's information. If you type something into the free-text box, we receive it, so type only what you are comfortable sending.

Do not send us your A-number through this website

This site never asks for an alien registration number (an A-number), and you should never put one in this form, in a contact email, or in any other unencrypted web form, on our site or anyone else's. The same goes for anything you consider sensitive: exact dates, the details of an arrest, or names of family members. Tell us those things by phone, or in person, or after we have a signed retainer and a secure way to exchange documents. A short summary is enough for us to tell you whether we can help.

Form submissions are not privileged until you are a client

Attorney-client privilege protects communications with a lawyer who represents you. Sending a web form does not make us your lawyers. Until we and you sign a written retainer agreement, what you send through this site is not a privileged communication. We still treat it as confidential as a matter of professional practice, and we do not share it, but the legal protection is different and you should know that before you write.

We also cannot promise that email or a web form is a secure channel. Email travels across networks we do not control, and a shared phone or computer can be read by whoever else uses it.

Server logs

Like nearly every website, the server that delivers these pages keeps a short technical log of requests. A log entry typically records an IP address, a timestamp, the page requested, the browser and operating system reported by your device, and the page you came from, if any. We use these logs to keep the site working and to see which pages are being read. We do not use them to build a profile of you, and we do not try to identify individual visitors from them.

Cookies

This site sets one cookie of its own: googtrans, which records the language you picked in the language selector so the machine translation stays on as you move between pages. If you never touch the language selector, that cookie is never set. You can delete it at any time in your browser settings, and the site will go back to English.

There are no advertising cookies on this site. No retargeting pixels, no social media tracking pixels, no third-party ad networks. We do not run advertising here, and we do not let anyone else run it here either.

The machine translation feature is provided by Google. When it runs, your browser contacts Google's servers, and Google's own privacy terms apply to that exchange. If you would rather not involve a third party, read the site in English and do not use the language selector.

Analytics

As of the date at the top of this page, no analytics service is configured on this site. There is no Google Analytics tag, no Plausible script, and no equivalent. If we add one later, we will update this policy first and say which service it is and what it records.

We do not sell your information

We do not sell, rent, trade, or share your information with lead generators, marketing companies, data brokers, or other law firms. We do not participate in any referral network that buys intake data. What you send us goes to the attorneys and staff at this firm and nowhere else.

There are two narrow exceptions, stated so this is honest: we use ordinary business vendors such as an email provider and a web host, who necessarily handle data in the course of delivering their service, and we will disclose information if a court order or a law requires it. If we ever receive a demand for information about a visitor or a client, we will resist it to the extent the law allows, and we will tell the person affected unless we are legally barred from doing so.

How to have your information deleted

Email info@usherlegal.com and ask us to delete what you sent. Tell us the name and the phone number or email address you used, so we can find the right record. We will delete it and confirm to you in writing.

There are two limits. If we already represent you, we keep your file for as long as the rules governing attorney files require, because that record protects you as much as it protects us. And if a matter is in active litigation, we may be obligated to preserve material until that ends. Outside those situations, an inquiry that did not become a case gets deleted on request, and we do not keep it to market to you.

Children

This site is written for adults. We do not knowingly collect information from anyone under 13 through this website. Children can be in removal proceedings, and we do represent minors, but the intake conversation happens with a parent, a legal guardian, or a sponsor, not through a web form filled out by a child. If you believe a child sent us information through this site, email us and we will delete it.

Links to other sites

We link out to government sources (EOIR, USCIS, the Federal Register, the courts) and to our firm's other websites. Once you follow a link off this site, this policy stops applying and the other site's policy takes over. We do not control what those sites collect. Government immigration websites in particular may log your visit, and that is worth knowing before you check a case status on a device you share.

Changes to this policy

If we change what we collect or how we handle it, we will change this page and update the date at the top. Material changes get a plain statement of what changed, not a silent edit.

If you would rather not write anything down, call

Some of the people who read this site are being watched, or believe they are, by a government, a family member, an employer, or someone they owe money to. If that is your situation, do not use the form. Call (718) 484-7510 from a phone you trust, or come to the Brooklyn office. A phone call leaves less behind than a web form, and we can tell you just as much in ten minutes on the phone as we can from anything you type here.

If you are worried about someone reading your browser history, most browsers have a private window, and you can clear history after you read. If you share a device with the person you are afraid of, use a library computer or a friend's phone.
